Terms of Service

These Terms of Service ("Terms") govern your use of XO Hosting services ("we", "us", "our") and supersede any information displayed on our website at https://xohosting.co.uk, which may be delayed or outdated. In the event of any discrepancies, the terms listed here prevail.

By using XO Hosting, you ("you", "user", "client", or "customer") agree to the following:

1. Indemnification & Relationship of Parties

You agree to indemnify and hold XO Hosting harmless from any claims, legal fees, or expenses arising from or related to your website.

Nothing in these Terms creates a partnership, joint venture, or employment relationship between you and XO Hosting.

We do not interact with your website's content except as required to maintain our services.

2. Payments & Pricing

• Charges must be paid on or before your service anniversary date.
• Payments not received within 3 days will be deemed late; services may be suspended or terminated.
• Restoring a cancelled or suspended account is subject to a £3.99 restoration fee, if a backup is available.
• XO Hosting may change prices or plan resources with at least 2 days’ notice.

3. Term & Termination

• Contracts begin with an initial term of one month (or as specified during sign-up).
• Renewals are automatic unless cancelled with at least 7 days' notice.
• Failure to cancel on time results in the next term’s payment being due.
• XO Hosting may suspend or terminate accounts without notice for Terms violations.
• Non-payment results in account termination after 7 days; Terms violations lead to termination within 3 days.

4. Refund Policy

• Hosting services include a 10-day money-back guarantee.
• Domain names and certain other services are non-refundable.
• Upgrades and downgrades are pro-rated based on the remaining term.
• Domain purchases are non-refundable after registration.

5. Refusal of Service

XO Hosting may refuse or cancel services at our sole discretion, especially for:

• Breach of Terms
• Staff abuse
• Network misuse

6. Website Content

Users must not host content that is illegal, harmful, or discriminatory. Prohibited content includes, but is not limited to:

• Pornography
• Streaming copyrighted content
• Illegal/pirated files
• Spam/email scripts
• IRC, proxy, or brute force scripts
• Hate speech, fraud, or scam-related content

7. Service Use

You must comply with all laws and maintain a current email on file.

Content on our website must not be copied or reproduced.

No postal or phone invoice notices will be provided unless required by law.

Resource Usage Restrictions:

• No process may use 25%+ system resources for over 90 seconds.
• No mass emailing or spam tools.
• No P2P/file-sharing, torrents, or cron jobs under 15 minutes.
• MySQL queries must complete in under 15 seconds.

Disk Space Usage: Accounts may not be used as file storage or backup services. Excessive usage may result in suspension.

8. Backups and Data Loss

• Weekly off-site backups are provided as a courtesy and overwrite the previous version.
• Users must maintain their own backups and are fully responsible for their data.
• Acceptable backup times: Monday–Sunday, 10 PM–6 AM GMT.

9. Security

Any attempt to harm XO Hosting or other customers results in immediate account termination.

10. Unsolicited Email (Spam)

Spam or unsolicited mass email is prohibited. XO Hosting may deactivate offending accounts without notice.

11. Account Setup

• Service setup may take up to 24 hours.
• All information provided must be accurate. False details may lead to termination.

12. Privacy

• User data is protected and never shared without consent, unless required by law.
• We may disclose user info to law enforcement upon valid legal request.

13. Scope of Agreement

These Terms apply to all services under XO Hosting, including subdomains and dedicated servers.

We may change these Terms at any time. It’s your responsibility to review them periodically.

14. Server Resources

Resources are shared. We cannot increase individual account allocations.

15. Third-Party Software

We use third-party software but are not liable for their availability or performance.
